Enter for a chance to win the Marie Claire Haute Card Sweepstakes on Aveda.com. To enter: click on the Aveda link on the Marie Claire Haute Card web page to access Aveda.com. Register or log in (if already registered as a member) to the Aveda website. Your registration serves as your entry into the sweepstakes at www.aveda.com. Sweepstakes ends December 31st, 2008. NO PURCHASE NECESSARY. VOID IN RHODE ISLAND AND WHERE PROHIBITED BY LAW.

THE AVEDA "Marie Claire Haute Card Sweepstakes" ("Sweepstakes") IS OPEN ONLY TO THOSE LEGAL RESIDENTS OF THE 50 UNITED STATES (EXCEPT RHODE ISLAND) AND THE DISTRICT OF COLUMBIA 18 YEARS OF AGE OR OLDER AS OF DATE OF ENTRY AND WHO MEET THE ELIGIBILITY REQUIREMENTS DETAILED BELOW. Sweepstakes starts at 12:01 AM (Eastern Time) on 09/01/08 and ends at 11:59 PM (Eastern Time) on 12/31/08 (the "Entry Period"). The sponsor of this Sweepstakes is Aveda Corporation, 4000 Pheasant Ridge Drive, Blaine, MN 55449 (the "Sponsor"). The Sweepstakes shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein. Certain restrictions may apply.

To Enter By Internet:
Beginning at 12:01 AM (Eastern Time) on 09/01/08 you may enter via the Internet by following the Marie Claire Haute Card link to www.aveda.com and logging in. You will be asked to provide your name, date of birth and e-mail address. A LIMIT OF ONE (1) ENTRY VIA THE ENTRY SITE PER VALID E-MAIL ADDRESS/PERSON WILL BE ACCEPTED DURING THIS SWEEPSTAKES. ALL ENTRIES ON THE ENTRY SITE MUST BE RECEIVED BY 11:59 PM (EASTERN TIME) ON 12/31/08..

The Sponsor and any and all Internet server(s) and access provider(s) (collectively, "Promotion Entities"), and each of their respective affiliates, subsidiaries, parent corporations and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents (collectively with the Promotion Entities, the "Releases") are not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to participant's or any other person's computer relating to or resulting from participation in the Sweepstakes; inability to access the Entry Site; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any website (including the Entry Site) or for any other reason whatsoever; printing or other errors; any entries which are late, lost, incomplete, misdirected, stolen, mutilated, illegible, or any combination thereof. Illegible and incomplete entries will be disqualified. All entries become the property of the Sponsor and will not be acknowledged or returned. False, fraudulent or deceptive entries or acts shall render entrants ineligible. By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Rules. Any entry information collected through the Sweepstakes shall be used only to administer the Sweepstakes in accordance with these Official Rules. If you elect during the entry process to have us share your personal information with any third party or to opt-in to receive communications from a third party, then your personal information shall be processed and used in accordance with such third party's policies and procedures. If you elect to register or opt-in for Aveda.com during the entry process or if you are already a registered user of Aveda.com, then your personally identifiable information applicable to your registration and/or opt-in will be processed and used in accordance with the aveda.com Privacy Policy: http://www.aveda.com/privacy.asp.

Winner Selection:
Winners will be selected in a random drawing from among all eligible entries on or about 1/10/09. The prize winner will be notified by e-mail by 1/20/09, and will be required to execute and return an Affidavit of Eligibility/Release of Liability form within 14 days of date of issuance. Failure to return all required forms within this time period or to comply with any other provision may result in the winner being disqualified and an alternate winner selected. If a prize notification or a prize is returned as undeliverable for any reason, the applicable prize will be awarded to an alternate winner. Prizes are not transferable, assignable, or redeemable for cash, and winner may not elect to substitute one prize for another. If necessary due to unavailability of a prize, a prize of equal or greater value will be awarded at the sole discretion of the Sponsor. All decisions are final.

All federal, state and local tax liabilities are the responsibility of the winners. Acceptance of a prize constitutes permission (except where prohibited) for the Sponsor to use the winner's name, likeness, biography, statements, and any other similar materials for marketing and publicity purposes without additional compensation or limitation.

Prizes:
GRAND PRIZE (1 grand prize will be awarded): Grand Prize consists of a gift card for Aveda products and/or services. Gift card valid only at participating Aveda locations. The retail value of the Grand Prize is $500.00. FIRST PLACE (5 first place prizes will be awarded): First Place Prize consists of a collection of Aveda Hand Relief™ and Foot Relief™ products. The approximate retail value ("ARV") of the First Place Prize is $51.00. The total ARV of all prizes to be awarded in this Sweepstakes is $551.00. The odds of winning a prize are determined by the total number of eligible entries received and are equal regardless of method of entry. Limit one (1) prize per household. All prizes are awarded "as is" with no guarantee, either express or implied. If by reason of a printing, typographical, or other error, more prizes are claimed than the number set forth in these official rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available. No more than the advertised number of prizes will be awarded. The prize will be shipped to the winner at the expense of Aveda Corporation. Selection of products and size of each product will be determined by Aveda Corporation. Prizes are not transferable, assignable or redeemable for cash.

Eligibility:
Sweepstakes open only to legal residents of the 50 United States (except Rhode Island) and the District of Columbia, 18 years of age or older as of date of entry. The officers, directors, employees, contractors, and agents of the Sponsor and Promotion Entities and the immediate families and those living in the same household of any of the above are not eligible. All federal, state and local rules and regulations apply. Void where prohibited or restricted by law.

General:
Entrants release and waive any claims they may have against Releasees for any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorney's fees) resulting from acceptance, use, or misuse of any prize or parts thereof, or participation in this Sweepstakes.

If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Sweepstakes and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor's sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, The Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Sweepstakes or any portion thereof. In the event this Sweepstakes is cancelled, the Sponsor reserves the right to conduct a random drawing to award all remaining prizes from among all eligible, non-suspect online entries received prior to the time of the action or event warranting such cancellation. If such cancellation, termination, modification, or suspension occurs, notification will be posted at http://www.aveda.com. Any attempt by an entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and/or civil laws, and should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Where a dispute arises about who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the e-mail account entered. The authorized account holder is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and that all eligibility requirements are met.

NOTE: Internet entry must be made by the entrant, only at the Entry Site. Entries made by any other individual or any entity, and/or originating at any other Internet website or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of any device to automate the entry process is prohibited.
